Your Order

Orders for Toffee products can be made online through this website ("Site"). Each order is made subject to and conditional upon acceptance of these Terms of Sale.

The final details of your order will be set out on the "Check Out" page of this Site prior to proceeding to the "Payments" pages (which are provided by a secure link to a payment service provider, such as PayPal). After the authorisation of your debit card, credit card or PayPal payment, we will send you an email confirming receipt of your order detailing the products you have ordered together with an order number. This email is not an order confirmation or order acceptance from Toffee. Toffee reserves the right to refuse any cancel any order for any reason. Toffee is not obliged to fulfil any order unless the order is accepted by Toffee.

For example, Toffee may, in its sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event we make a change to or cancel an order, we will attempt to notify you by contacting the email, billing address or telephone number provided at the time the order was made, as Toffee considers best. Toffee reserves the right to limit or prohibit orders that, in Toffee's sole discretion, appear to be placed by dealers, resellers or distributors.

An order is deemed to have been accepted by Toffee, and then cannot be changed or cancelled, only when Toffee ships the product ordered.

Changes, Errors and Cancellations

It is your responsibility to inform Toffee immediately of any errors in your order. If you'd like to cancel or change your order, please email info@Toffee.com.au as soon as possible. We'll do everything we can to accommodate your request but please bear in mind that our order fulfilment and shipping systems are designed to get orders on their way quickly and efficiently and an order may have already been despatched prior to you notifying us of a change, error or cancellation. Toffee cannot change or cancel an order once it has been despatched. If you cancel or change an order for a product that qualified you for a discount, promotion or special deal, you may no longer receive that discount, promotion or special deal.

Product Warranty

Toffee warrants to you, the original purchaser, that the product will remain free from defects in materials and workmanship for three (3) years from the date of purchase. If you believe there is any fault in workmanship or materials in connection with the product within 3 years from the date of purchase, please forward it to Toffee, at the address given below, with proof of your purchase.

If, on inspection by us, the product is found to be defective in materials or workmanship and has been returned within 3 years from the date of purchase, Toffee will, at its option, repair or replace the product with the same or a similar product to the same value as the original without charge, or pay the cost of having the product repaired. This warranty will not apply to defects in the product caused by accidental damage, abuse, misuse, improper care, alteration or the natural breakdown of product. Toffee will be responsible for any reasonable expenses (such as postage) that you incur as a result of any warranty claim accepted by Toffee.

This warranty is in addition to and does not affect your statutory rights. The following concerns those statutory rights only. Our products come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the products repaired or replaced if the products fail to be of acceptable quality and the failure does not amount to a major failure.

Otherwise, to the fullest extent permitted by law and except as imposed by the Competition and Consumer Act 2010 and/or any equivalent local statute, Toffee's liability for any cause in respect of the supply of products is limited to the payments made by you to Toffee for the product and all other warranties (express or implied and arising by virtue of statute or otherwise) and all other liability, including for physical or financial consequential loss or damage (including loss of profit) and whether arising from negligence or otherwise are excluded.

Pricing

The price that you pay for the product will be the price that is displayed on the Site at the "Check Out" stage of the purchasing process.

For deliveries in Australia, prices include GST and shipment by express post.

For deliveries outside Australia, you will be given a choice of international airmail or courier, and a charge will be quoted and added to your order. Some large orders and bulky items may require an adjustment to the quoted delivery costs.

Any discounts Toffee offers are time limited and are subject to product availability. The price of such products may change from time to time and changes in price will be available on the Site.

We will take payment from your debit or credit card, or through Paypal, after you have authorised the payment by confirming the "Check Out" stage of the order. If we are unable to supply the product that you have ordered, we will attempt to contact you by telephone or email to offer you either a full refund or a substitute product. If we do not receive a response from you within 24 hours of our first attempt to contact you, we will refund the total amount we deducted from your debit or credit card within 3 business days.

We will endeavour to ensure that all prices on our Site are accurate. However, from time to time pricing errors may occur. If an error is found in the price of the product you have ordered, we will contact you as soon as possible. If a product?s correct price is lower than the price stated on our Site, we will charge the lower amount to your debit or credit card and send the product to you. If a product?s correct price is higher than our stated price, then we will give you the option of either continuing with your purchase at the correct price or cancelling the order affected by the error. We will deem the order to be cancelled if we do not receive a response from you within 24 hours of our first attempt to contact you. In such a case, we will refund the total amount we deducted from your debit or credit card.

Delivery

Toffee will endeavour to dispatch products by express post, international airmail or courier as specified above promptly following receipt of your order, unless cancelled for any reason prior to shipment.

Delivery is deemed to have been made, and title and risk is transferred to you, when Toffee delivers the products to its carrier.

International airmail is the non-traceable airmail option for non-Australian delivery addresses. Your order is sent via airmail to the country of destination at which point its delivery is reliant on local postal services. International airmail orders are not insured nor traceable and Toffee cannot be held liable for loss or damage in transit.

International courier is the tracked, priority-paid, door-to-door option for non-Australian delivery addresses. Your order is couriered via air and road transport by a private courier company contracted to Toffee. International courier orders are insured for loss or damage in transit.

Unless otherwise expressly agreed in writing, any delivery date or time specified by us in any quotation, despatch note or otherwise, is a best estimate only and we will not be liable to you for any loss or damage sustained by you if we fail to meet that delivery date or time.

For deliveries outside of Australia, you may be required to pay import duty, customs charges or other local taxes. Customs policies vary widely from country to country so please contact your local customs office for further information. Please note that the payment of any import duties, customs charges, local taxes or any administration charges paid to couriers in relation to these fees, is your responsibility. Toffee is not responsible for the payment of any of the abovementioned charges.

Return Policy

For customers from Australia who purchase from the toffee online store.

If you are not completely satisfied with your purchase, you may return a product within 30 days of receipt for replacement or refund. We offer free returns within Australia. Please contact info@toffeecases.com for a consignment slip and instructions for your return. After 30 days, Toffee will not accept returns for any reason other than defects. Refunds must be accompanied by the original receipt and will be made in the form of the original payment.
